Описание: A landmark work of political and legal philosophy, Ronald Dworkin's Taking Rights Seriously was acclaimed as a major work on its first publication in 1977 and remains profoundly influential in the 21st century. A forceful statement of liberal principles - championing the legal, moral and political rights of the individual against the state - Dworkin demolishes prevailing utilitarian and legal-positivist approaches to jurisprudence. Developing his own theory of adjudication, he applies this to controversial public issues, from civil disobedience to positive discrimination. Elegantly written and cuttingly insightful, Taking Rights Seriously is one of the most important works of public thought of the last fifty years.

Описание: How should a judge`s moral convictions bear on his judgments about what the law is? The author charts a variety of dimensions - semantic, jurisprudential and doctrinal - in which law and morals are interwoven. He argues that pragmatism is empty as a theory of law, and that value pluralism misunderstands the nature of moral concepts.

Описание: When the Cold War ended, some people called it the "end of history." Capitalism and liberal democracy had prevailed. Later, when the West clashed with radical Islam, Americans realized history hadn't ended after all--at least not abroad. Now, in How Marx Can Save American Capitalism, Ronald W. Dworkin shows us that even the home front is in play and capitalism and liberal democracy are threatened. Dworkin uses Karl Marx to tip the balance in their favor--a paradox, as Marx was the sworn enemy of capitalism and liberal democracy, but also logical, as Marx knew the weak spots in capitalism and democracy better than anyone. In the past, capitalism's weak spots were obvious: sweatshops, workhouses, and hunger. The twentieth century welfare state saved capitalism by fixing them. Today's weak spots are less obvious; they don't even seem related-- mass loneliness, a declining birth rate, young people postponing adulthood, and workers using sleep aids to function on the job. Yet they pose the same risk to capitalism that child labor and horrid factory conditions once did. Marx's ideas applied to contemporary America show how they are all of apiece. Saving capitalism demands a third way--not rigid Republican conservatism or blind Democratic state interventionism, but a new politics in which the state focuses laser-like on advanced capitalism's unique threats to private life, while leaving much of the free market intact.
A major American legal thinker, the late Ronald Dworkin also helped shape new dispensations in the Global South. In South Africa, in particular, his work has been fiercely debated in the context of one of the world’s most progressive constitutions. Despite Dworkin’s discomfort with that document’s enshrinement of “socioeconomic rights,” his work enables an important defense of a jurisprudence premised on justice, rather than on legitimacy. Beginning with a critical overview of Dworkin’s work culminating in his two principles of dignity, Cornell and Friedman turn to Kant and Hegel for an approach better able to ground the principles of dignity Dworkin advocates. Framed thus, Dworkin’s challenge to legal positivism enables a theory of constitutional revolution in which existing legal structures are transformatively revalued according to ethical mandates. By founding law on dignity, Dworkin begins to articulate an ethical jurisprudence responsive to the lived experience of injustice. This book, then, articulates a revolutionary constitutionalism crucial to the struggle for decolonization.

Описание: In his last book, Ronald Dworkin addresses timeless questions: What is religion and what is God`s place in it? What are death and immortality? He joins a sense of cosmic mystery and beauty to the claim that value is objective, independent of mind, and immanent in the world. Belief in God is one manifestation of this view, but not the only one.

Описание:
Ronald Dworkin is widely accepted as the most important and most controversial Anglo-American jurist of the past forty years. And this same-named volume on his work has become a minor classic in the field, offering the most complete analysis and integration of Dworkin's work to date. This third edition offers a substantial revision of earlier texts and, most importantly, incorporates discussion of Dworkin's recent masterwork Justice for Hedgehogs.
Accessibly written for a wide readership, this book captures the complexity and depth of thought of Ronald Dworkin. Displaying a long-standing commitment to Dworkin's work, Stephen Guest clearly highlights the scholar's key theories to illustrate a guiding principle over the course of Dworkin's work: that there are right answers to questions of moral value. In assessing this principle, Guest also expands his analysis of contemporary critiques of Dworkin. The third edition includes an updated and complete bibliography of Dworkin's work.

Описание: A battle now rages in the U.S. between crony capitalism and capitalism, with the future of liberal democracy at stake. This book argues that capitalism can-and should-prevail, but to do so lawmakers must change direction and address core areas of instability in people`s private lives that Karl Marx`s ideas expose.
