Описание: This book examines how new challenges such as the financial crisis, terrorism, mass migration and other country-specific problems have affected constitutional review in Europe. Adopting a common analytical structure, it examines how the issues have been addressed in ten individual countries.
Описание: This book undertakes the first comparative constitutional analysis of the Kyrgyz Republic and Republics of Kazakhstan, Turkmenistan, Uzbekistan and Tajikistan in their cultural, historical, political, economic and social context. The first chapter provides a general overview of the diverse and dynamic constitutional landscape across the region. A second chapter examines the Soviet constitutional system in depth as the womb of the Central Asian States. A third chapter completes the general picture by examining the constitutional influences of the 'new world order' of globalisation, neoliberalism, and good governance into which the five states were thrust.
The remaining five chapters look in turn at the constitutional context of presidents and governments, parliaments and elections, courts and rights, society and economy and culture and identity. The inquiry probes the regional patterns of neo-Sovietism, plebiscitary elections, weak courts and parliaments, crony capitalism, and constraints on association, as well as the counter- tendencies that strengthen democracy, rights protection, and pluralism. It reveals the Central Asian experience to be emblematic of the principal issues and tensions facing contemporary constitutional systems everywhere.

Описание: This book offers a comprehensive, comparative analysis of how 11 representative European countries tackle the questions of who (should) uphold(s) the Constitution and how constitutional review is organised.
This volume provides a holistic presentation of the reality of constitutional change in 18 countries (the 15 old EU member states, Canada, Switzerland and the USA). The essays offer analysis on formal and informal constitutional amendment bringing forth the overall picture of the parallel paths constitutional change follows, in correlation to what the constitution means and how constitutional law works. To capture the patterns of constitutional change, multi-faceted parameters are explored such as the interrelations between form of government, party system, and constitutional amendment; the interplay between constitutional change and the system of constitutionality review; the role of the people, civil society, and experts in constitutional change; and the influence of international and European law and jurisprudence on constitutional reform and evolution. In the extensive final, comparative chapter, key features of each country's amendment procedures are epitomized and the mechanisms of constitutional change are explained on the basis of introducing five distinct models of constitutional change. The concept of constitutional rigidity is re-approached and broken down to a set of factual and institutional rigidities. The classification of countries within models, in accordance with the way in which operative amending mechanisms connect, leads to a succinct portrayal of different modes of constitutional change engineering.
This book will prove to be an invaluable tool for approaching constitutional revision either for theoretical or for practical purposes and will be of particular interest to students and scholars of constitutional, comparative and public law.
Описание: The purpose of this book is to move beyond the approach which views energy as a purely geopolitical tool of the Russian state and assumes a `one size fits all` approach to Central and Eastern Europe (CEE) energy security.
Описание: The role of local people in contemporary nature conservation practices is often poorly understood or neglected. This book, therefore, examines questions of local participation at the nature-society nexus within national parks in the transitional context of Central and Eastern Europe (CEE). The post-1990 reconfiguration of conservation paradigms in this part of the world has re-opened various age-old debates about the protection and administration of natural heritage. Further complicating the situation has been the introduction of market-based principles, which has embedded the entire process in broader dynamics of neoliberalization and the capitalist space economy. Providing an integrated perspective on why, how and for whom nature conservation practices have been implemented in CEE, this book sheds further light upon the mechanisms through which such practices both redefine and are affected by the everyday life of people living in national parks. Offering a critical global review of the environmental motivations and power interests behind the creation of national parks, as well as a typology of the relations between local people and the dynamics of nature protection in them, this work challenges the dichotomy between developed and developing countries that pervades much of the academic literature on nature protection. Author Saska Petrova highlights the lessons that can be learnt by applying the experiences of local community participation in environmental management in CEE to other locations undergoing major systemic change in their environmental governance practices, such as the 'low carbon transition' that is currently unfolding at a global scale.
Описание: In this book, Bogusia Puchalska develops an original theory of democratic constitutionalism and uses it to support the argument that constitution-making and law-making in constitutional moments should be politically, and not just constitutionally, legitimate. In doing so she expertly assesses the potential implications of the prospects of democratic consolidation and constitutionalism in Poland after 1989 and asks whether it is likely to be applicable to other transition countries such as Hungary, Czech Republic and Slovakia. This original and informative book should be read by all curious to understand how the democratic learning and the foundations of grass-root constitutionalism might have been damaged in post-communist countries.
Описание: Although Kierkegaard's reception was initially more or less limited to Scandinavia, it has for a long time now been a highly international affair. As his writings were translated into different languages his reputation spread, and he became read more and more by people increasingly distant from his native Denmark. While in Scandinavia, the attack on the Church in the last years of his life became something of a cause celebre, later, many different aspects of his work became the object of serious scholarly investigation well beyond the original northern borders. As his reputation grew, he was co-opted by a number of different philosophical and religious movements in different contexts throughout the world. The three tomes of this volume attempt to record the history of this reception according to national and linguistic categories. Tome II covers the reception of Kierkegaard in Southern, Central and Eastern Europe. The first set of articles, under the rubric 'Southern Europe', covers Portugal, Spain and Italy. A number of common features were shared in these countries' reception of Kierkegaard, including a Catholic cultural context and a debt to the French reception. The next rubric covers the rather heterogeneous group of countries designated here as 'Central Europe': Hungary, the Czech Republic, Slovakia and Poland. These countries are loosely bound in a cultural sense by their former affiliation with the Habsburg Empire and in a religious sense by their shared Catholicism. Finally, the Orthodox countries of 'Eastern Europe' are represented with articles on Russia, Bulgaria, Serbia and Montenegro, Macedonia and Romania.
