Leading Cases in Constitutional Law, A Compact Casebook for a Short Course, 2019

Описание: An annually-revised paperback designed for a single-semester course on constitutional law, this book is roughly half the length of many hardcover casebooks. The four renowned authors, now including Michael Dorf and Frederick Schauer, are co-editors of a long-time favorite teaching book, the much larger and newly revised Constitutional Law: Cases, Comments & Questions, 13th Edition. "Leading Cases," which is a stripped-down version of that book, contains "the essentials" for teaching a basic course in constitutional law. Because the organization of the compact book parallels that of the much lengthier Choper - Dorf - Fallon - Schauer casebook, which contains extensive Notes & Questions, the latter can serve as a "resource" book for instructors teaching from the paperback. This edition of "Leading Cases" is up to date through the completion of the Supreme Court Term that ended in June 2019. Subsequent editions of "Leading Cases" will continue to be published every summer for classroom use in the fall and will include all the significant cases handed down during the most recent Supreme Court Term.

Описание: How does the state, as a public authority, relate to those under its jurisdiction through the criminal law? Connecting the ways in which criminal lawyers and public lawyers address questions of criminal law's legitimacy, contributors to this collection explore issues such as criminal law-making and jurisdiction; the use of criminal law to suppress challenges to state authority; the purposes and mechanisms of state punishment; the value of coherence in legal systems; the interface between tort and crime; and the importance of doctrinal guidance in the application of criminal law. Overall, the collection aims to enhance and deepen our understanding of criminal law by conceiving of the practices of criminal justice as explicitly and distinctly embedded in the project of liberal self-governance. (Series: Studies in Penal Theory and Penal Ethics, Vol. 6) Subject: Criminal Law, Constitutional Law, Legal Philosophy]

Unborn Human Life and Fundamental Rights: Leading Constitutional Cases under Scrutiny. Concluding Reflections by John Finnis

Описание:

This book presents a collection of studies by top scholars on leading cases from twelve different jurisdictions defining the legal status of unborn human life. The cases under study pertain to three distinctive cultural and constitutional systems: Latin American Constitutional Courts and the Inter-American Court of Human Rights, European Constitutional Courts and the European Court on Human Rights, as well as Common Law jurisdictions. With a special conclusion by Professor John Finnis, drawing together the many treads of the individual chapters into a comprehensive whole, this book lays the basis for further comparative study of the legal and moral reasoning underlying judicial decisions which either recognize or deny legal personhood and/or equal dignity to unborn human beings.

Robert P. George McCormick, Professor of Jurisprudence and Director of the James Madison Program in American Ideals and Institutions, Princeton University:
"Pilar Zambrano and William L. Saunders have done a great service by giving us a thorough compilation of the law of various jurisdictions concerning the status and rights of the unborn. They have brought together an impressive group of scholars and obtained from them work of the highest intellectual caliber."

Prof. Carlos Massini-Correas, University of Mendoza and University of Buenos Aires:
"In undertaking the very unusual task of analyzing both the legal and the moral horizon of interpretation underlying leading judicial decisions, this book represents an exceptional shortcut to the bulk of constitutional and philosophical arguments in favor of the enhancement of the value of unborn human life to the status of a right. This mixed perspective of study allows us to avoid the usual fallacy of both sides of the abortion debate, to overlook either its moral or its legal framework."

Описание:

Following the retirement of Justice Anthony Kennedy and the controversial confirmation of Justice Brett Kavanaugh, the Supreme Court plunged into a contentious term that featured divisive cases involving abortion, immigration, capital punishment, and voting rights on the court's docket. In American Justice 2019, Mark Joseph Stern examines the term's most controversial opinions and highlights the consequences of Chief Justice John Roberts stepping into a new role as the court's swing vote.

No longer bound by Kennedy's erratic moderation, Roberts has begun doling out victories to both Democrats and Republicans, albeit with a clear rightward tilt. Early in the term, Roberts delivered a public rebuke to Trump's attacks on the judiciary, foreshadowing his refusal to tolerate some of the president's most extreme contortions of the law. Stern tracks the chief justice's evolution from staunch conservative to part-time centrist. Along the way, he details the term's blockbusters and surprises, including an unlikely alliance between Justices Neil Gorsuch and Sonia Sotomayor on criminal justice, and an especially radical ruling on the death penalty that overturned decades of precedent. Stern's account depicts a court sharply divided over its role in American democracy, with the man at its center striving to stay above the political fray without abandoning his conservative instincts.

Описание: This title is the work of nationally renowned experts on the subject of constitutional criminal procedure. It is ideally suited for a survey course designed to explore and critically examine how the U.S. Supreme Court has dealt with a wide range of highly controversial issues that arise at various stages of the criminal process. Considerable effort has been made to set forth the views of all members of the Court in landmark and important recent cases. The modest size of this volume has been attained not by collecting snippets of many opinions, but by the judicious selection of leading cases. An outstanding feature is the illuminating introductory commentary that appears throughout the book and place the selected cases in general historical and doctrinal perspective.
