Based on new readings of the peace agreements and the post-conflict political systems, the book goes beyond accounts that present a static picture of 'fixed divisions' in these cases. By exploring how formal electoral politics and the informal political spheres of artistic, cultural, judicial and protest movements already contest the politics of division, the book argues that the post-conflict political systems in Northern Ireland and Bosnia and Herzegovina are in a process of deconstruction. The text adds to the Derridean lexicon by developing the idea of a 'deconstructive conclusion', which challenges historical understandings of conflicts at the same time as challenging their consequences in the present. The study provides a critical contribution to peacebuilding and International Relations literature, by demonstrating how Derridean concepts can be utilised to provide fresh understandings of conflict and post-conflict situations, as well as allowing for political interventions to be made into these processes.

Описание: This book explains why there is a pronounced disjuncture between R2P's habitual invocation and its actual influence, and why it will not make the transformative progress its proponents claim. Rather than disputing that R2P is a norm, or declaring that norms are insignificant, Hehir engages with post-positivist constructivist accounts on the role of norms to demonstrate first, that the efficacy of a norm is not directly related to the extent to which it is proliferated or invoked, and second, that in the post-institutionalization phase, norms undergo both contestation and (potentially regressive) reinterpretation. This volume analyses the evolution of R2P, and demonstrates that it has been steadily circumscribed and co-opted, so that today it has no power to meaningfully influence the behaviour of states. It is essential reading for academic audiences in the disciplines of International Relations and International Law.
Situations of serious or massive violations of human rights are no longer purely of domestic concern, and sovereignty can no longer be an absolute shield for repressive governments in such circumstances. Based on this realization, the international community has recognized a responsibility to protect individuals in states where their governments are unable or unwilling to provide protection against the most serious violations. However, so far, only one intergovernmental organization, the African Union (AU), has explicitly made the right to intervene in a Member State part of its foundational text in Article 4(h) of its Constitutive Act. Although there have been cases of Article 4(h)-type interventions in Africa, the AU Assembly has not yet invoked Article 4(h) explicitly.
This book brings together experts in the field to explore the potential application of Article 4(h), and the complexities that may explain its non-invocation so far. Although Article 4(h) is noble in purpose, its implementation faces several legal and policy challenges given that the use of force penetrates the principles of state sovereignty and non-intervention - the very cornerstones upon which the AU is founded. This book considers these issues, as well as the need to reconcile Article 4(h), in so far as it allows the AU to exercise military intervention to protect populations at risk of mass atrocities, with the provisions of the Charter of the United Nations.
