Democracy and Sovereignty: Rethinking the Legitimacy of Public International Law, Christian Walter, Daniel Erasmus Khan, Evelyne Lagrange, Stefan Oeter
Описание: This text explores how the public purpose doctrine reconciles the conflicting obligations that states have to engage in regulatory sovereignty while honoring host-state obligations to protect foreign investment. It examines the multiple permutations and iterations of the doctrine and the inherent fundamental flaws that lead to disparities in the relationship between investors and states.

Описание: This third edition of Rethinking Public Relations argues that public relations is weak propaganda. While earlier editions focused on PR as representative of the uneven power distribution in society, this book goes further, conceiving the power of PR as more than structural but also as having an important rhetorical component.

Описание: The settlement of Versailles was more than a failed peace. What was debated at the Paris Peace Conference of 1919–1920 hugely influenced how nations and empires, sovereignty, and the international order were understood after the Great War—and into the present. Beyond Versailles argues thatthis transformation of ideas was not the work of the treaty makers alone, but emerged in interaction with nationalist groups, anti-colonial movements, and regional elites who took up the rhetoric of Paris and made it their own. In shifting the spotlight from the palace of Versailles to the peripheries of Europe, Beyond Versailles turns to the treaties' resonance on the ground and shows why the principles of the peace settlement meant different things in different locales. It was in places a long way from Paris—in Polish borderlands and in Portuguese colonies, in contested spaces like Silesia, Teschen and Danzig, and in states emerging from imperial collapse like Austria, Egypt, and Iran—that notions of nation and sovereignty, legitimacy, and citizenship were negotiated and contested.
Описание: Modern family life exhibits a huge variety of new forms. Legal responses to these new forms illustrate the continuing differences between European nations. Nonetheless, the Strasbourg Court has been increasingly active in this area, which provides fertile ground for testing the legitimacy of the Court’s interpretation of the European Convention on Human Rights. When national law refuses to recognize a claimed right, litigants regularly reassert that right before the Strasbourg Court. This has forced it to seek answers to complex domestic controversies, such as the legal recognition for same-sex partners and transgender persons, the ethics of adoption and reproductive rights, the legal regime for cohabitants, or the accommodation of immigrants’ aspiration to family reunion. Placing family rights at the core of the judicial legitimacy debate, this book provides a critical analysis of the standards of family rights protection under the Convention. It evaluates the Court’s interpretive methodology and discusses the tensions inherent in its supranational quasi-constitutional function. These include the risk of excessive deference to national authorities, at the expense of the effective enforcement of universal rights; the addition of 'new rights'; and inattention to the division of responsibilities between democratic processes within sovereign States and the subsidiary international review.
