Описание: This book explores the prosecution of wartime sexual violence in international criminal law and asks what the juridicalisation of gender-based violence signifies for women. The book explores the portrayal of the various gendered identities that surface in armed conflict and it asks whether the law is capable of reflecting these in subsequent judgements. Focusing on the International Criminal Tribunal for the Former Yugoslavia and the International Criminal Tribunal for Rwanda as well as subsequent developments in the International Criminal Court, the book shows how the tribunals have delivered landmark jurisprudence in the area of sexual violence against women and provided a legacy for how gender justice is incorporated into international law. However, Daniela Nadj argues that in the relevant cases there is a tendency to depict women in monolithic fashion with little agency or sense of identity beyond their ethnicity. By bringing to the surface the complexity and multi-faceted gendered identities in wartime, the book calls for a reconceptualisation of notions of femininity in armed conflict.

Описание: Rape and the Law: Historical and Contemporary Perspectives examines the legal history of rape to understand why modern audiences continue to disagree about the nature of the crime, why society as a whole often fails to believe and support victims, and how we can change our understanding of and approach to the crime. The volume begins with an examination of American rape law, explaining the historical sources of the law and analyzing the meanings and ideas embedded in the conventional definition of rape. The second part explores how the conventional law of rape affects attitudes about autonomy and accountability, gives priority to violence over other forms of communication, and imposes risks and burdens to all. It also addresses the risks and realities of false accusations. Finally, the book proposes a revised understanding of the legal basis of rape, reconceiving the legal right and injury involved and advancing a positive consent standard.Rape and the Law is part of the Cognella Series on Family and Gender-Based Violence, an interdisciplinary collection of textbooks featuring cross-cultural perspectives, cutting-edge strategies and interventions, and timely research on family and gender-based violence.

Описание:
Arguing that law must be looked at holistically, this book investigates the 'hidden gender' of the so-called neutral or objective legal principles that structure the law addressing violence against women. Adopting an explicitly feminist perspective, it investigates how legal responses to violence against women presuppose, maintain and perpetuate a certain context that may not in fact reflect women's experiences.
Carline and Easteal draw upon relevant legislation, case law and secondary studies from a range of territories, including Australia, England and Wales, the United States, Canada and Europe, to contextualize and critique different policy responses. They go on to examine the potential and limits of law, making recommendations for best practice models of policymaking and law reform.
Aiming to help improve government, community and legal responses to women who experience violence, Shades of Grey - Domestic and Sexual Violence Against Women: Law Reform and Society will assist law-makers, academics, policymakers and a wider audience in understanding the complexities of violence against women.
Описание: This book examines violence against women in Africa and criminal justice from the perspective of African scholars, practitioners and experts. As a global and long-standing issue, violence against women is gaining public visibility across the African continent with some states announcing a national crisis warranting immediate redress. At the global level, the elimination of all forms of violence against all women and girls forms a key part of United Nations Sustainable Development Goal 5: Gender Equality. Split across two volumes, these books present a comprehensive analysis of the latest research and theories, principles and practices of criminal justice systems, criminal justice accountability mechanisms, and the key challenges women face in their quest for justice on the African continent. Volume I focusses on legislation and its impact, the limitations of criminal justice responses, and the cultural and social norms regarding access to justice. Volume II examines sexual violence and vulnerable women’s access to justice in Africa. They adopt a comparative approach that highlight gaps and good practices to provide a rich source of authoritative information for promoting an intra-African dialogue and cross-fertilization of ideas across the different criminal justice traditions in Africa. Both volumes seek to advance discussions on eliminating violence against women in Africa and speak to those interested in criminal justice, violence, gender studies and African legal studies.
Описание: 'Honor' is used as a justification for violence perpetrated against women and girls considered to have violated social taboos related to sexual behavior. Several ‘honor’-based murders of Kurdish women, such as Fadime Sahindal, Banaz Mahmod and Du’a Khalil Aswad, and campaigns against 'honor'-based violence by Kurdish feminists have drawn international attention to this phenomenon within Kurdish communities. Honor and the Political Economy of Marriage provides a description of ‘honor’-based violence that focuses upon the structure of the family rather than the perpetrator’s culture. The author, Joanne Payton, argues that within societies primarily organized by familial and marital connections, women’s ‘honor’ is a form of symbolic capital within a ‘political economy’ in which marriage organizes intergroup connections. Drawing on statistical analysis of original data contextualized with historical and anthropological readings, Payton explores forms of marriage and their relationship to ‘honor’, sketching changing norms around the familial control of women from agrarian/pastoral roots to the contemporary era.
