Описание: This volume examines the implementation of the Return Directive from the perspective of judicial dialogue. While the role of judges has been widely addressed in European asylum law and EU law more generally, their role in EU return policy has hitherto remained under explored. This volume addresses the interaction and dialogue between domestic judiciaries and European courts in the implementation of European return policy. The book brings together leading authors from various backgrounds, including legal scholars, judges and practitioners. Katharine Cleland'sIrregular Unionsprovides the first sustained literary history of clandestine marriage in early modern England and reveals its controversial nature in the wake of the Elizabethan Religious Settlement, which standardized the marriage ritual for the first time. Cleland examines many examples of clandestine marriage across genres. Discussing such classic works as The Faerie Queene, Othello, and The Merchant of Venice, she argues that early modern authors used clandestine marriage to explore the intersection between the self and the marriage ritual in post-Reformation England.
The ways in which authors grappled with the political and social complexities of clandestine marriage, Cleland finds, suggest that these narratives were far more than interesting plot devices or scandalous stories ripped from the headlines. Instead, after the Reformation, fictions of clandestine marriage allowed early modern authors to explore topics of identity formation in new and different ways.

Описание: It is by now almost a cliche that the flight and expulsion of Germans from east-central Europe at the end of the Second World War was a taboo topic in the German Democratic Republic. According to this claim, the Socialist Unity Party (SED) suppressed reference to flight and expulsion so as not to upset its socialist neighbors. This book shows that such a view does not hold up to serious scrutiny. While the topic may not have been addressed in the realm of politics or official commemoration, it was picked up again and again in literature, particularly fiction. Representations of flight and expulsion were by no means restricted, as some have asserted, to Christa Wolf's novel Kindheitsmuster: Niven's study documents around one hundred novels and short stories published in the GDR that address flight or expulsion. He argues that in the 1950s and early 1960s GDR fiction included many refugee figures. The predominant emphasis was on their integration under socialism rather than their experience of flight and loss of home; nevertheless, flight and to a lesser degree expulsion were depicted, as was their impact on individuals. They continued to be portrayed in the late GDR and in post-unification east Germany. Flight and expulsion were subject to a developing literary discourse in the GDR, a discourse that this book explores. Governments increasingly become aware of irregular immigration and are forced to re-negotiate the dilemma of open but secure borders. Rethinking Authority in China’s Border Regime: Regulating the Irregular investigates the Chinese government’s response to this phenomenon. Hence, this book presents a comprehensive analysis of the Chinese border regime. It explores the regulatory framework of border mobility in China by analysing laws, institutions, and discourses as part of an ethnographic border regime analysis. It argues that the Chinese state deliberately creates ‘zones of exception’ along its border. In these zones, local governments function as ‘scalar managers’ that establish cross-border relations to facilitate cross-border mobility and create local migration systems that build on their own notion of legality by issuing locally valid border documents. The book presents an empirically rich story of how border politics are implemented and theoretically contributes to debates on territoriality and sovereignty as well as to the question of how authority is exerted through border management. Empirically, the analysis builds on two case studies at the Sino-Myanmar and Sino-North Korean borders to illustrate how local practices are embedded in multiscalar mobility regulation including regional organizations such as the Greater Mekong Subregion and the Greater Tumen Initiative.
